Acceptable Use Policy

Please read the Intellitech I.T. Solutions Limited, hereafter referred to as “Intellitech”, Acceptable Use Policy, hereafter referred to as “AUP” below. This is strictly enforced and is to benefit all our clients and ourselves.Feel free to contact us anytime by navigating to the online contact page.

Intellitech’s AUP is provided to give our customers and users a clear understanding of what Intellitech I.T. Solutions Ltd. expects of them while using the service(s) provided by Intellitech I.T. Solutions Ltd., it’s partners, agents, and service providers. All users of Intellitech I.T. Solutions Ltd.’s services: those who access some of our Services but do not have accounts, as well as those who pay a service fee to subscribe to the Services, must comply with this AUP and it’s Terms of Service, hereafter being referred to as “TOS”.

Use of Intellitech’s service constitutes acceptance and agreement to it’s AUP as well as it’s TOS.

Customers are responsible for complying with this AUP and for violations attributable to their customers and users, whether authorised or not by the Customer.
Customers must take all reasonable steps to ensure that their customers and users comply with this AUP.

This AUP does not: (a) obligate Intellitech to monitor, review, or police the data and content residing on its network or; (b) create any obligation of Intellitech to any party that is not a Customer.
Intellitech I.T. Solutions Ltd. expressly disclaims any liability for the data and content residing / hosted on its network and for ANY actions of its customers or clients.

This document is intended to provide a basic understand of Intellitech I.T. Solutions Ltd.’s AUP. The following are guidelines for the establishment and enforcement of Intellitech’s AUP:

• Ensure reliable service to our clients & customers
• Ensure security and privacy of our systems and network, as well as the networks and systems of others
• Comply with existing laws of the United Kingdom (UK)
• Maintain our reputation as a responsible service provider
• Encourage responsible use of the Internet and discourage activities which reduce the usability and value of Internet services
• Preserve the value of Internet resources as a conduit for free expression and exchange of information
• Preserve the privacy and security of individual users

Intellitech I.T. Solutions Ltd. intends to provide its clients & customers access to everything the Internet has to offer. While Intellitech is firmly committed to the principles of free speech, certain activities that may be damaging to the resources of Intellitech and the Internet, will not be permitted under the guise of free speech. The resources of the Intellitech I.T. Solutions Ltd. and the Internet are limited, and abuse of these resources by one user (or a collection of users or groups) has a negative impact on the entire community.

Intellitech does not actively monitor the activity of it’s users’ accounts except for measurements of system utilisation and the preparation of billing records. However, in our efforts to promote good citizenship within the Internet community, we will respond appropriately if we become aware of inappropriate use of our service(s).

You may not use your dedicated rack or virtual site to publish material, which Intellitech determines, at its sole discretion, to be unlawful, indecent or objectionable. For purposes of this policy, “material” refers to all forms of communications including but not limited to narrative descriptions, graphics (including photographs, illustrations, images, drawings, logos), executable programs, video recordings, and audio recordings.

If an account is used to violate the Intellitech AUP or TOS, we reserve the right to terminate your service without notice. We prefer to advise customers of inappropriate behavior and any necessary corrective action, however, flagrant violations of the AUP will result in immediate termination of the service.

Intellitech’s failure to enforce this policy, for whatever reason, shall not be construed as a waiver of our right to do so at any time.

As a member of our network community, you must use your Internet access responsibly. If you have any questions regarding this policy, please contact us.

VIOLATIONS OF Intellitech I.T. Solutions Ltd.’s AUP

The following constitute violations of this AUP:

Adult Sites: We strictly prohibit any adult (pornographic) web-sites on our servers. Intellitech I.T. Solutions Ltd. works on morals and ethics and does not allow these form of sites including but not limited to objectionable sites, sites linking to pornographic sites (outside links) and even pornographic advertisements on your own site. We do not allow ANY dating sites or any dating related websites either, regardless if they contain pornographic content or not. We monitor ALL sites on our servers and will immediately suspend your account if found violating our policy.

Illegal use: Intellitech I.T. Solutions Ltd.’s services MAY NOT be used for ANY illegal purposes, or in support of illegal activities. Intellitech I.T. Solutions Ltd. reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.

Gambling Websites: Gambling sites (online casinos, betting and similar) are prohibited from being hosted on our servers.

Harm to minors: Use of the Intellitech I.T. Solutions Ltd.’s service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography.

Threats: Use of the Intellitech I.T. Solutions Ltd.’s service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.

Harassment: Use of the Intellitech I.T. Solutions Ltd.’s service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another.

Fraudulent activity: Use of Intellitech I.T. Solutions Ltd.’s’ service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as “pyramid schemes”, “ponzi schemes”, and “chain letters”.

Forgery or impersonation: Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous re-mailers or nicknames does not constitute impersonation.

Unsolicited commercial e-mail / Unsolicited bulk e-mail (SPAM) Use of the Intellitech I.T. Solutions Ltd.’s service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of the offending Intellitech I.T. Solutions Ltd. account.

IMPORTANT NOTICE:

Anyone hosting websites or services on their server that support spammers or cause any of our IP space to be listed in any of the various Spam Databases will have their server immediately removed from our network. The server will not be reconnected until such time that you agree to remove ANY and ALL traces of the offending material immediately upon reconnection and agree to allow us access to the server to confirm that all material has been COMPLETELY removed. Severe violations may result in immediate and permanent removal of the server from our network without notice to the customer. Any server guilty of a violation MAY be immediately and permanently removed from our network without notice.

E-mail / News Bombing: Malicious intent to impede another person’s use of electronic mail services or news will result in the immediate termination of the offending account.

E-mail / Message Forging: Forging any message header, in part or whole, of any electronic transmission, originating or passing through the Intellitech I.T. Solutions Ltd.’s service is in violation of this AUP.

Usenet Spamming: Intellitech has a zero tolerance policy for the use of its network for the posting of messages or commercial advertisements which violate the rules, regulations, FAQ or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.

Unauthorised access: Use of the Intellitech’s service to access or to attempt to access, the accounts of others, to penetrate or to attempt to penetrate security measures of Intellitech’s or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending account is subject to immediate termination.

Copyright or trademark infringement: Use of any of Intellitech’s service to transmit any material (by e-mail, uploading, posting, hot linking, directly linking or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorised copying of copyrighted material, the digitisation and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorised transmittal of copyrighted software. If you copy, distribute or install the software in ways that the license does not allow, you are violating copyright laws. If caught with pirated software, you and / or your company may be liable under both civil and criminal law, and you may be fined and / or imprisoned. In compliance with the Digital Millennium Copyright Act (the “DMCA”), please send DMCA notifications of claimed copyright infringements to us.

Collection of personal data: Use of the Intellitech’s service to collect, or attempt to collect, personal information about third parties with / without their knowledge or consent are strictly prohibited.

Network disruptions and unfriendly activity: Use of the Intellitech’s service for any activity which affects the ability of other people or systems to use Intellitech’s services or the Internet. This includes “denial of service” (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member’s responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorised entry and/or use of another company and/or individual’s computer system will result in immediate account termination. Intellitech I.T. Solutions Ltd. will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.

Spam: Sending of unsolicited bulk communication is prohibited using Intellitech’s network and / or services. Violations of this policy carry severe penalties, including but not limited to termination of service.

Fraud: Involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it.

Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right: Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated.

Distribution of Viruses: Intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in the immediate termination of the offending account.

Inappropriate Use of Software: Use of software or any device that would facilitate a continued connection, i.e. pinging, while using Intellitechs’ services could result in suspension and termination of service.

Third Party Accountability: Intellitech I.T. Solutions Ltd.’s subscribers will be held responsible and accountable for any activity by third parties, using their account, that violates guidelines created within the AUP.

Violation Of Intellitech I.T. Solutions Ltd.’s Accounts: It is absolutely forbidden to host any AUP violating content on our servers. Accounts found hosting this material will be subject to immediate cancellation without refund.

IRC networks: It is absolutely forbidden to host an IRC server that is part of or connected to another IRC network or server. Servers found to be connecting to or part of these networks will be immediately removed from our network without notice. The server will not be reconnected to the network until such time that you agree to completely remove any and all traces of the IRC server, and agree to let us have access to your server to confirm that the content has been completely removed. Any server guilty of a second violation will result in immediate account termination.

Software Installation: any software you install must NOT conflict with any pre-installed software we provide you to your dedicated server(s). This includes but not limited to: control panels, operating systems, mail servers, ftp servers, firewall and any other software that may possible conflict with the provided operating system and control panel. You will be responsible for a £100 operating system/control panel re-image (re-install) fee without exceptions should your installed software corrupt the operating system.

E-mail Policy

Customer may not send unsolicited bulk messages over the Internet (i.e., “spamming”) and must comply with all relevant legislation and regulations on bulk and commercial e-mail, including the CAN-SPAM Act of 2003.

Mass Mailings – Customers may not sending mass unsolicited e-mail, which is email that is sent to recipients who have not double-opted in to mailings from the Customer. Customers who send mass mailings must maintain complete and accurate records of all consents and opt-ins, including the actual e-mail and its headers, and provide such records to Intellitech I.T. Solutions Ltd. upon its request. If a Customer cannot provide positive and verifiable proof of such consents and opt-ins, Intellitech I.T. Solutions Ltd. will consider the mass mailing to be unsolicited.

Mailing Lists – Customers are prohibited from operating mailing lists, listservs, or mailing services that do not target an audience that has voluntarily signed up for e-mail information using a double opt-in process or that has made their e-mail addresses available to Customer for distribution of information. Customers who operate mailing lists must maintain complete and accurate records of all consents and opt-ins (including the actual e-mails and their headers) and provide such records to Intellitech I.T. Solutions Ltd. upon its request. If a Customer cannot provide positive and verifiable proof of such consents and opt-ins, Intellitech I.T. Solutions Ltd. will consider the list mailing to be unsolicited. Any Customer-maintained mailing list must also allow any party on the list to remove itself automatically and permanently.

Other prohibited mailing activities include the following:

• Use of Intellitech I.T. Solutions Ltd.’s’ network for the receipt of replies to unsolicited mass e-mail
• Forgery of e-mail headers (“spoofing”)
• Spamming via third-party proxy, aggregation of proxy lists, or installation of proxy mailing software
• Configuration of a mail server to accept and process third-party messages for sending without user identification and authentication
• Hosting web pages advertised within “spam e-mail” sent from another network (“spamvertising”)

Block Removal – If, as a result of a Customer’s actions, Intellitech I.T. Solutions Ltd’s mail servers or IP address ranges are placed on black hole lists and other mail filtering software systems, Intellitech I.T. Solutions Ltd. shall charge the Customer £100 in advance, and a further £100 per hour thereafter for any necessary remedial actions.

IRC Policy

Customers are prohibited from operating and maintain IRC servers which connect to global IRC network. Use of IRC plug-ins, scripts, add-ons, clones or other software designed to disrupt or deny service to other users is prohibited. Harassing or abusive IRC activity is expressly prohibited under the AUP, including (i) disruption or denial of service or (ii) the use or joining of “botnets” or the use of IRC BNC’s or other proxy and re-direction software. If a customer’s servers are frequently compromised or attract denial of service or distributed denial of service attacks that disrupt or denies service to other customers or users, Intellitech may null-route, filter, suspend, or terminate that customer’s service.

Usenet Policy

Usenet posts and content must conform to standards established by the Internet community and the applicable newsgroup charter. Intellitech reserves the right to determine whether such posts violate the AUP.

Legal Investigations

Customers will cooperate and comply with any civil or criminal investigation regarding content located on its Servers, including, without limitation, the following: discovery orders, freeze orders, search warrants, information requests, wire taps, electronic intercepts and surveillance, preservation requests, and any other order from a court or government entity (each an “Investigation”). Intellitech I.T. Solutions Ltd. reserves the right to comply with any Investigation without notice to a Customer. Customers shall not be entitled to service credits, and Intellitech I.T. Solutions Ltd. shall not be in default under any agreement for Services, if its compliance with any Investigation causes a Customer to incur downtime or requires the sequestering of all or a portion of the Servers.

Security Policy

You, the customer, are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorised access to your account. In addition, you may not use your account to breach security of another account or attempt to gain unauthorised access to another network or server.

Your password provides access to your account. It is your responsibility to keep your password secure.
Sharing your password and account access with unauthorised users is prohibited. You should take care to prevent others from using your account since you will be held responsible for such use.

Attempting to obtain another user’s account password is strictly prohibited, and may result in termination of service.

You must adopt adequate security measures to prevent or minimise unauthorised use of your account.

You may not attempt to circumvent user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorised to access, or probing the security of other networks. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools.

You may not attempt to interfere with service to any user, host or network (“denial of service attacks”). This includes, but is not limited to, “flooding” of networks, deliberate attempts to overload a service, and attempts to “crash” a host.

Users who violate systems or network security may incur criminal or civil liability. Intellitech I.T. Solutions Ltd. will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.

Network Performance Policy

Intellitech I.T. Solutions Ltd.’s accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination of your account.

You are prohibited from excessive consumption of resources, including CPU time, memory, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performances of Intellitech I.T. Solutions Ltd.’s systems or networks. Intellitech I.T. Solutions Ltd. reserves the right to terminate or limit such activities.

Reporting Violations of AUP

Intellitech I.T. Solutions Ltd. requests that anyone who believes that there is a violation of this AUP direct the information to the Abuse Department at Abuse Alert

If available, please provide the following information:
– The IP address used to commit the alleged violation
– The date and time of the alleged violation, including the time zone or offset from GMT
– Evidence of the alleged violation

E-mail with full header information provides all of the above, as do system log files. Other situations will require different methods of providing the above information. Intellitech I.T. Solutions Ltd. may take any one or more of the following actions in response to complaints:

– Issue written or verbal warnings
– Suspend the Member’s newsgroup posting privileges
– Suspend the Member’s account
– Terminate the Member’s account
– Bill the Member for administrative costs and/or reactivation charges
– Bring legal action to enjoin violations and/or to collect damages, if any, caused by violations

Violations of AUP

Intellitech I.T. Solutions Ltd. may enforce this AUP with or without notice to a Customer by any actions it deems necessary in its sole discretion, including the following:

– Disabling access to a Customer’s content that violates this AUP
– Removal of DNS records from Servers
– Blocking mail or any other network service
– Effecting IP address null routing
– Suspending or terminating of a Customer’s service
– Taking direct action against a Customer’s users and customers.

The aforementioned list of actions shall not be construed in any way to limit the actions or remedies that Intellitech I.T. Solutions Ltd. may take to enforce and ensure compliance with this AUP. Intellitech I.T. Solutions Ltd. reserves the right to recover any and all expenses, and apply any reasonable charges, in connection with a Customer’s violation of this AUP. No service credits will be issued for any interruption in service resulting from violations of this AUP.

Intellitech I.T. Solutions Ltd. reserves the right at all times to investigate any actual, suspected, or alleged violations of this AUP, with such investigation to include accessing of data and records on, or associated with, any Server.

Revisions to the AUP

Intellitech I.T. Solutions Ltd. reserves the right to revise, amend, or modify this AUP, our TOS and introduce any other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with our TOS.
